These Terms are a contract between you and AgentEd Tracker, a business based in Colorado, United States, operating under the trade name "AgentCE Tracker" ("AgentEd Tracker", "we", "us"). You can reach us at support@agentcetracker.com.
By creating an account or continuing to use AgentCE Tracker (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. You must be at least 18 years old and, if using the Service on behalf of a business, have authority to bind it.
AgentCE Tracker is a tool that helps real estate agents track continuing-education hours and license renewal dates across states. It is a tracking aid only. It is not legal advice and it is not a substitute for verifying requirements directly with your state real estate commission.
You are responsible for the accuracy of the information you enter (license numbers, renewal dates, CE certificates), for keeping your login credentials confidential, and for all activity under your account. Notify us immediately of any unauthorized access.
You agree not to: (a) use the Service for any unlawful purpose or to violate your state's licensing rules; (b) upload content you don't have the right to share; (c) attempt to breach, probe, disrupt, or overload the Service; (d) introduce malware or scrape the Service; (e) reverse engineer, decompile, or attempt to derive source code; or (f) resell, sublicense, or share your account with others.
The Service, including all software, source code, database structures, designs, text, graphics, logos, and the "AgentCE Tracker" trade name, is owned by AgentEd Tracker or its licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal, professional use as a real estate licensee. All rights not expressly granted are reserved. You retain ownership of the content you upload (such as your CE certificates); you grant us a limited license to host, store, and process that content solely to provide the Service to you.
We work to keep the Service available and accurate, but we do not guarantee uninterrupted, timely, secure, or error-free operation. Scheduled maintenance and unforeseen outages may occur.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. State CE requirements, license lookups, and renewal dates surfaced in the app may be incomplete, out of date, or incorrect. Always verify your CE and license status directly with your state real estate commission.
To the fullest extent permitted by law, AgentEd Tracker is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lapsed license, missed renewal deadline, CE shortfall, lost commission, or professional discipline arising out of your use of the Service. Our total aggregate liability for any claim is capped at the amount you paid for the Service in the 12 months before the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence where such exclusion is prohibited by law.
You agree to indemnify and hold harmless AgentEd Tracker from claims arising out of the content you upload, your unlawful use of the Service, or your breach of these Terms.
We may suspend or terminate your access for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. You may delete your account at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnity, governing law) will do so.
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-laws principles. Courts located in Colorado will have exclusive jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have in your country of residence.
We may update these Terms. Material changes will be notified in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
